Recently I gave strong support to a measure that will strengthen the way the city deals with illegal sign postings by giving authority to more city employees to take down the signs.

Councilmen’s, John Crawford, R-at-large, Tim Pape, D-5th and Tom Smith, R-1st announced on Tuesday, August 21st a proposal for an amendment to the city’s Municipal Code, Chapter 99: “Streets and Sidewalks; Trees and Shrubs” that governs placing signs on public land. The Councilmen have publicly discussed the need for greater oversight on the illegal postings, as well as speaking with neighborhood groups who have asked for the changes in the city ordinance. Such sign littering has been springing up on public land—right-of-ways, median strips, parks, and structures such as utility poles—in ever increasing numbers over the past several years. It is against the law to place most signage on public land.

The amendment now defines Public Land and gives a broad group of city employees the charge to take down the signs, posters, and notices that are illegally placed on public land. The offending materials will be taken to the City’s Street Department facility on Wallace Street and destroyed. The amendment allows for penalties to be given to businesses posting illegal signs and messages. Citations will be issued through the mail by the Right-of-Way Department. Penalties range from $50 for the first offense; $100 for the second; and $250 for the third offense and subsequence offenses.

Any Federal and State authorized signs are exempt. Other signage placed on private property that has received an encroachment agreement, waiver or license through the city’s Department of Public Works is also exempt.

I am eager to see enforcement of the amended ordinance and fully support the new language.
